The iCare for Families, iCare for Childcare, iCare for Education, and Daycare Advantage Membership programs are all operated by Daycare Advantage, Inc. and adhere to the same terms & conditions.

Terms for Advantage Membership

You understand that the Advantage Membership is good for one year of date of purchase. Upon automatic renewal you will have access to another 12 months of benefits. You understand that the Advantage Membership does not include tuition discounts at childcare centers in the network. However, all other benefits, including Advantage Savings discounts, iCare Rewards, and access to all of the resources on the Web Site are included.

Terms for Advantage Plus Membership (includes tuition discount) & Daycare Advantage Tuition Discount Only Program

Advantage Plus members receive access to the Advantge Savings network, library, childcare locator, and iCare Rewards account. The additional benefit to Advantage Plus members is the childcare tuition discount. You understand that the Advantage Plus Membership is for parents who wish to enroll their child in a childcare center for the first time or change the program their child attends. Participating Childcare centers will only make the tuition discount available to new enrollment. You must inform the childcare center director that you are an Advantage Plus member upon initial contact in order to be eligible for discount. In addition, Childcare Partners have allotted a limited number of discounted seats in each facility for Daycare Advantage Plus members. You must verify on the childcare center’s Daycare Advantage webpage that the discount is currently available. You should be sure there is a childcare center you want to enroll your child in before becoming an Advantage Plus Member. If you are unsure of which membership to purchase you are urged to become an Advantage member and upgrade to Advantage Plus at a later date. You should perform your own research to determine if childcare center meet your personal standard of quality included but not limited to visiting prospective centers in person.

You understand that Daycare Advantage recommends you do all necessary research regarding your childcare decision BEFORE purchasing an Advantage Plus membership including, but not limited to, verifying that there is a participating Daycare Advantage network childcare provider within the proximity you desire (identified through our Childcare Locator). iCare Rewards and the savings network are currently available nationally, however, not all states have participating childcare centers. Please refer any childcare center across the country by contacting us.

You understand that you will not receive a refund should you realize there was not a participating Childcare Partner you wish to enroll your child/children in once you purchase an Advantage Plus Membership.

You understand that the Advantage Plus Membership is good for one year of date of membership purchase. Upon automatic renewal, you will have access to another 12 months of benefits including the tuition discount at participating childcare centers in the Daycare Advantage Network. As long as you remain an Advantage Plus member, you will continue to receive the discount available to you when you signed up with participating childcare center. It is your responsibility to show childcare director your membership card upon annual renewal to insure continued discount.

You understand that you will not receive any refund and will not continue to receive the discount should you decide to withdraw your child from a participating childcare center in which you were originally enrolled. Should you choose to enroll your child in another participating childcare center, than you shall receive the discount advertised by the new facility for the remainder of the 12 month term of membership. Upon renewal of membership, your tuition discount would continue for another 12 months.

Billing Terms

Membership renewal will be through recurring automatic billing 12 months from date of registration and every 12 months thereafter. Member can contact the company at any time to request cancellation of membership before the rebill date. Member will be notified via email approximately 2 weeks prior to the anniversary of the rebill reminding them that the transaction is about to occur, providing contact information to request re-bill not occur (cancel membership), to request a downgrade in membership, and with information on how to update credit card information and email address. If there is a recurring billing payment scheduled for a day that does not occur in a given month, payment is made the next day of the following month. Regular membership fee is $29 annually for Advantage Membership and $79 for Advantage Plus membership

No Unauthorized Use of the Program.

You agree that you will not, and will not permit others to provide any unauthorized third party with access to this service or any information, data, text, links, images, software, chat, communications and other content available through the Internet and proprietary to Daycare Advantage (collectively, "Content") by any means.

Electronic Communication

The information communicated via the Web Site constitutes an electronic communication. When you communicate with us through electronic media, such as e-mail, you are communicating with us electronically. You agree that we may communicate electronically and that such communications, as well as notices, disclosures, agreements, and other communications that we provide to you electronically, are equivalent to communications in writing and shall have the same force and effect as if they were in writing and signed by the party sending the communication. You agree that Daycare Advantage may contact you on a periodic basis to conduct member surveys and promotions.

Indemnification

You agree to indemnify and hold harmless Daycare Advantage, Inc., its directors, officers, employees, agents, co-branders, subsidiaries, parents, daycare providers, and affiliates, from and against any and all liability, losses, claims, demands, disputes, damages, and costs of any kind, including, without limitation, reasonable attorneys' fees and costs of litigation resulting from or in any way connected with your use of the Web Site or membership. This includes use of any daycare found on the daycare locator and use of any content or link posted on The Website.

Modification or Suspension of the Web Site & Membership

You agree that Daycare Advantage, Inc. may, in its sole discretion, and at any time, modify, discontinue, or suspend its operation of the Web Site, or any part thereof, temporarily or permanently, without notice to you, and you agree that Daycare Advantage will not be liable for the consequences of doing so.

If Daycare Advantage, Inc. feels that member violates any terms and conditions set forth in this agreement, membership shall be terminated by Daycare Advantage, Inc. upon notice with no refund.

Termination

You agree that Daycare Advantage, Inc. may, in its sole discretion, and at any time, terminate your use of the Web Site, You further agree that Daycare Advantage, Inc. will not be liable to you or to any third party for the consequences of any termination of your use of or access to the Web Site. In the event of any termination of your use of or access to the Web Site, you agree that the provisions of the Agreement regarding Protection of Intellectual Property Rights and License, Trademark Notices, Indemnification, Disclaimer or Warranties, Limitations of Liability, and Applicable Law shall survive any such termination.

Severability of Agreement

If any provision of the agreement is found by a court or other binding authority to be invalid, you agree that every attempt shall be made to give effect to the parties' intentions as reflected in that provision, and the remaining provisions contained in the agreement shall continue in full force and effect.

Quality Daycare Disclaimer

The Early Learning Self-Assessment (ELSA) is a self-assessment developed by Daycare Advantage, Inc. that is based upon early childhood education standards outlined by several State Departments of Education. Childcare centers that have these markers or activities evident in their program may be considered high quality. Childcare centers must achieve 80% proficiency on the ELSA in order to become a Daycare Partner in our network. Click here to view the ELSA.

Please note that Daycare Advantage, Inc.relies on the honesty of the representative from each childcare center for accuracy and cannot be held responsible if a childcare center misrepresents itself. A representative from Daycare Advantage, Inc. does NOT visit the childcare center at any time. It is your sole responsibility to determine which program is best for your children and should not rely on the daycare’s affiliation with Daycare Advantage, Inc.. The ELSA focuses on curriculum. State licensing dictates safety and other environmental concerns.

Any childcare center that comes up on search results was on that particular state’s list of licensed childcare programs as of March 2007. However, childcare license status can change without the knowledge of Daycare Advantage, Inc. Therefore, it is the SOLE responsibility of the PARENTS to verify each centers licensure status. It is possible for a center to be on the list and lose their state license/certification before Daycare Advantage, Inc. has removed them from the search results.
